What California Law Says About Spousal Support

Under California legislation, a spouse undergoing divorce or separation may qualify for financial assistance, known as spousal support or alimony. This financial aid aims to preserve the standard of living established during the marriage, ensuring that both parties can adequately meet their post-divorce financial requirements.

The determination of spousal support encompasses various considerations, including the duration of the marriage, the financial standing and earning abilities of both spouses, alongside their contributions throughout the marriage. These factors influence the decision on the amount and length of the support awarded.

There are two types of spousal support in California. Temporary spousal support is paid while a divorce is pending but not yet finalized. Long-term spousal support is paid after the divorce is finalized for the period of time deemed necessary by the court.

Factors That Influence Spousal Support Decisions

When it comes to determining spousal support, the court evaluates numerous aspects to ensure a balanced resolution. Important considerations include the length of the marriage and the earning disparity between the spouses. The court won’t look just at both parties’ current income, but their earning potential as well.

If you have Spouse A who earns the majority of the household income and you have Spouse B who earns no income because they’ve spent the last 25 years working as a homemaker and stay-at-home parent, Spouse B would need a considerable amount of training and education before they would even be close to becoming self-sustaining. If you take the same situation, but Spouse B earns $2,000 per month working part-time and has maintained their professional certifications during their five-year marriage, Spouse B is in a much better position to accelerate their career and become self-sustaining in a shorter period of time.

How to Calculate Spousal Support

Spousal support amounts are generally determined by the divorcing couple or the court. This topic is often a heated topic during divorce negotiations. If it’s clear that spousal support will be awarded by the court, it’s often better for the spouses to agree on an amount rather than taking their chances on the court’s discretion. As a general rule, marriages lasting less than 10 years result in spousal support for half the duration of the marriage.

If a marriage lasted longer than ten years, there’s no automatic assumption about how much spousal support is necessary. While determining an appropriate amount of alimony, the court will look at the factors listed in Family Code 4320. They include both spouses’ ages and health, income levels, earning capacity, standard of living during the marriage, separate property and debt, and any sacrifices made during the marriage. The amount awarded will be heavily affected by how large the earning disparity is.

Modifying or Terminating Spousal Support

Whether due to a significant change in financial circumstances or personal circumstances, the need to adjust the terms of spousal support can arise. California law acknowledges these shifting realities by allowing for the modification or termination of spousal support orders. For example, spousal support may terminate when the receiving spouse remarries. It is also expected that spousal support will end when either party passes away. If the receiving spouse becomes self-sufficient or gains the ability to support themselves, the paying spouse can ask the court to change the agreement. Furthermore, the paying spouse may request a modification if their income changes significantly.
